Terms & Conditions
1.1. In these Terms and Conditions (‘these conditions’), the following terms shall have the following meanings:
Gordonstoun International Summer School (‘GISS’, ‘summer school’ or ‘the school’) is operated by Gordonstoun Schools Limited (company number 288105, Scottish Charity number SC037867).
By making an application to enroll their child (‘the Student’) at GISS, the parent or guardian who has signed the Registration Form (‘the Parent’) accepts that they shall be bound by these Terms and Conditions.
‘Student Code of Conduct’ means the rules and procedures of the School as set out in the Student’s Code of Conduct, a copy of the current version of which is provided to each child on arrival;
‘Registration Form’ the GISS registration form provided by the GISS Office;
‘GISS’, is the summer school which the Student is attending, as set out in the Registration Form;
‘Student’ the child or children who will be attending GISS as specified in the Registration Form;
‘Fee’ the fees shown on the Registration Form or published literature;
‘Full Fee Date‘ the date specified, 31st March, by which the fees relating to the School must be received;
‘Services‘ the provision of the summer school for the Student by the Gordonstoun International Summer School;
‘you‘ and ‘your‘ the Student’s parent(s) or guardian(s) who has signed the Registration Form as parent or guardian of a child or who has assumed parental responsibility for such child.
1.2. The headings in these Terms and Conditions are for ease of understanding only and do not form part of these terms and conditions.
- Supply of Services
2.1. GISS shall provide the Services to the Student subject to these Conditions. By registering for the summer school you agree on behalf of yourself and the Student to be bound by these Conditions. These Conditions constitute the entire agreement between GISS and you/the Student and may not be varied except in writing by the Director of GISS. Plagiarized
2.2. Registrations are accepted at the discretion of GISS and are not transferable.
- Payment of Fees
3.1. On acceptance of your registration, you shall pay GISS the Fees in full by the date shown on the invoice, paid by credit card or by direct bank transfer.
3.2. The Full Fee Date of GISS Fees is 31st March. After March 31st, full payment is due at time of registration.
Payment Includes: accommodation, food, laundry, supervision, instruction, entertainment, activities and airport transfer. Also included is medical care provided on-site and by the UK National Health Service.
- Transport to and from home city
- Pocket money
- Private health care or medical expenses (as per clause 9.2)
- Additional/bespoke airport transfers (as per clause 2).
4.1. If you wish to cancel a GISS registration for any reason, you must do so via e-mail to GISS at firstname.lastname@example.org .
4.2. If a registration is cancelled after payment and before 31st March, the fee will be returned less £350 administration fee.
4.3. If a registration is cancelled on or after 31st March, the fee will be retained by GISS.
4.4. Refunds cannot be made due to illness so it is recommended that appropriate medical/travel insurance is purchased in advance.
4.5. In the unlikely event that the summer school is cancelled by GISS, the total liability of GISS will not exceed the Fees GISS have actually received.
- Your Responsibility
5.1. You agree to be wholly liable for any and all actions and/or omissions of the Student. Without prejudice to the generality of the foregoing, you shall be liable for any liability, financial or otherwise, or injury or damage to property caused by the Student whilst at the School, and shall fully indemnify GISS, their agents, contractors and/ or employees for any loss, damage, costs or expenses resulting from such liability, injury or damage.
5.2. The Parent agrees to the Student participating in the GISS programme and acknowledges that there is an inherent risk in all sporting and adventurous activities.
5.3. It is your responsibility to give GISS information (name, address and other contact details) of every person who is a parent and/or guardian and/or has parental responsibilities for the Student. It is also your responsibility to tell us who the Student normally lives with.
5.4. GISS reserves the right to withdraw the Student from any activity at any time on the grounds of safety or unsuitability.
- Student Behaviour
6.1. Students should display good manners and courtesy to all staff and other students.
6.2. Students should treat their own possessions, those of GISS, other students and staff with respect.
6.3. The following will not be tolerated by any student:
- Any behavior which is counter to the health and safety of the student, other students and staff.
- The possession and consumption of alcohol, tobacco or drugs.
- Intimate relations.
- Dishonesty or theft.
- Any aggressive behaviour, bullying and unkindness towards others.
6.4. GISS reserves the right to search the bags and other personal property of all Students in appropriate circumstances.
6.5. Please note that if the Student does not adhere to these conditions, GISS reserve the right to discipline the student, in consultation with the parents, or remove the student from GISS in accordance without refund and in such event the Student may be sent home at your expense.
7.1. Except in respect of death or personal injury caused by GISS negligence, GISS shall not be liable to you or the Student by reason of any representation (unless fraudulent) or any implied warranty, conditions or other term or any duty at common law or under the express terms of this Agreement for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by our negligence or the negligence of our servants, or agents or otherwise) which arise out of or in connection with the provision of the Services or their use by you or the Student, and our entire liability under or in connection with this Agreement shall not exceed the amount of our Fees for the provision of the Services.
7.2. Where GISS provides, in connection with the provision of the Services, any goods or equipment or services supplied by a third party, GISS does not give any warranty, guarantee or other terms as to their quality, fitness for purpose, performance or otherwise.
7.3. GISS shall have no liability to the Student for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by you which are incomplete, incorrect, inaccurate or illegible, or arising from the Student’s late arrival or non-arrival, or any other fault of you or the Student.
7.4. We advise you to take out travel insurance covering you against cancellation, curtailment, personal liability, personal accident and lost property.
7.5. GISS reserves the right to alter programmes, activities, itineraries, excursions, age brackets, premises and personnel as it thinks fit and without notice.
7.6. GISS will not be bound by any statement unless it is in writing and authorised by a Director of GISS.
- Travel and Transport
8.1. Students should arrive on the designated arrivals and departures date. If students need to arrive/depart early or late, the school can arrange airport transportation and a Guardian at additional cost. The cost of excess baggage is entirely the responsibility of the Student/parents.
8.2. Transfers for Students to and from Aberdeen or Inverness Airport on the arrival and departure dates are free of charge. Any private transportation arranged by parents will be at their own cost.
8.3. Parents must complete and return the Travel Details form by June 1st 2017.
8.4. Should parents wish to accompany children on the transfers every effort will be made to include them on the transportation scheduled for their child to the School. GISS cannot be responsible for scheduling or bearing the cost of parents return transportation to airports.
8.5. A valid passport is essential for travel to the UK with an expiry date of at least 6 months beyond the end date of your visit, where applicable.
8.6. In the event that the Student requires a VISA, you take full responsibility for ensuring you obtain a VISA. GISS will provide a Visa Support Letter if required. In the event that you do not obtain a VISA, it is deemed that you have cancelled your booking and your booking will be subject to Clauses 4.2 and 4.3.
9.1. Parents must complete and return the Student Health Form by June 1st 2017. School cannot accept a Student without a completed Health Form or be held liable for any issues arising from a Heath Form completed incorrectly or with any omissions. GISS reserve the right not to accept your Booking on the grounds that any such medical problem is not conducive to the Student’s, or other ‘Students’, participation at GISS.
9.2. In the event that the Student becomes ill or incapacitated during the summer school, you agree to medical treatment being given to the Student, if required, in accordance with the recommendations of a qualified medical practitioner. Permission is also granted for routine medical care for the Student by GISS personnel of any prescribed medication which the Student brings to the School, or which is prescribed while at School, or the use of over the counter medication when needed. Any additional costs for treatment, including emergency dental or specialized care and repatriation to home country will be charged to the parents.
9.3. If the Student becomes ill, suffers from any injury, or comes into contact with any contagious or infectious disease during the 21 days prior to the commencement of the summer school, you must immediately notify the School in writing and provide a medical certificate from the Student’s doctor giving approval for the Student to participate in the summer school.
- Valuables and Lost Property
10.1. GISS will not be liable for any item of jewellery, electronics or valuable property brought to the School by the Students.
10.2. GISS will not be responsible for any property left at the School (by the Student or otherwise), and may dispose of any such property if not claimed and collected by you within 2 months of the end of summer school.
11.1. You acknowledge that GISS may use for publicity purposes and without prior notification any photograph or video taken of the Student at the School, and any written statement made by you or the Student, unless the Parent notifies GISS to the contrary in writing.
11.2. The Student and the Parent will be asked to complete a questionnaire at the end of the summer school. The parent and the Student hereby consent to GISS using this material in future promotions, unless the Parent notifies GISS to the contrary in writing.
12.1. Your consent to us holding information about your child in paper or electronic format in accordance with the principles of the Data Protection Act 1998.
12.2. You consent to us making use of information relating to your child whilst he/she is at the School and after he/she has left for the purposes of communicating and managing relationships with pupils and former pupils of the School.
- Force Majeure
13.1. The School will not assume responsibility or liability for any damage, loss, claim or injury (including claims for the alteration or cancellation of summer school) resulting from events beyond our reasonable control including, without limitation, acts of God, strikes, incidents of terrorism, politically or religiously motivated violence, war, pandemic outbreak of disease, compliance with any law or governmental order, rule, regulation or direction, environmental contamination, malicious damage, threats to safety, fire or extreme weather. No refund will be made, except at GISS’ discretion.
14.1. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
14.2. This agreement is governed by the laws of Scotland and the parties submit to the exclusive jurisdiction of the Scottish Courts.
14.3. GISS reserve the right to make reasonable modifications to these terms and conditions from time to time.
14.4. The operation of the Contracts (Rights of Third Parties) Act 1999 is excluded.
